Terms of Service

Acceptance of Terms

By accessing or using Peek ("the Service"), you agree to be bound by these Terms of Service ("Terms"). If you disagree with any part of these terms, you may not access the Service. These Terms apply to all users of the Service, including free users and Pro subscribers.

  • You must be at least 13 years of age (or 16 in the European Economic Area) to use Peek
  • If you are using Peek on behalf of an organization, you represent that you have authority to bind that organization to these Terms
  • Your use of the Service constitutes acceptance of these Terms and our Privacy Policy
  • These Terms constitute a legally binding agreement between you and Peek
  • These Terms will remain in effect while you use the Services

Description of Service

Peek is a browser extension and design tool that allows users to extract design assets, colors, typography, and other design elements from websites. The Service includes both free and Pro subscription tiers with different features and capabilities.

  • Service Availability:The Service may be updated, modified, or discontinued at any time with reasonable notice to users; we do not guarantee uninterrupted availability
  • Feature availability and capabilities may vary between free and Pro tiers
  • Specific features and their availability are subject to change and are described within the Service interface
  • Third-Party Components:The Service may integrate with third-party services (Google OAuth, LemonSqueezy, Supabase) subject to their respective terms of service

User Accounts and Registration

Pro subscription features require account registration. Free users may use the Service without creating an account.

  • Account Creation:Pro accounts are created using Google OAuth authentication; you must provide accurate and complete information; you must be eligible to use Google services
  • Account Security:You are responsible for maintaining the confidentiality of your account credentials; you must notify us immediately of any unauthorized access; we are not responsible for unauthorized access due to your failure to secure your Google account
  • Account Responsibility:You are responsible for all activities that occur under your account; we are not liable for any loss or damage arising from unauthorized use of your account
  • Account Limits:Pro subscriptions are limited to 3 devices per account; device identification is used to enforce this limit; attempting to exceed this limit may result in account suspension
  • Account Information:You must keep your account information up to date; you may update your profile information through the Service settings
  • Single User Accounts:Accounts are for individual use only and may not be shared; if we detect account sharing or suspicious activity, we may temporarily suspend your account pending verification; contact us at [email protected] to resolve any issues

Privacy & Data Handling

Your privacy is important to us. Our Privacy Policy outlines how we collect, use, and store your data. By using Peek, you consent to our data practices.

  • Privacy Policy:Our Privacy Policy provides detailed information about how we handle your data; by using the Service, you agree to our Privacy Policy
  • Data Collection:We do not collect or store sensitive user browsing data beyond what is required to operate the Service; free users' data remains local on their device
  • Data Usage:We use collected data only to provide and improve the Service, process payments, and comply with legal obligations
  • Data Security:We implement appropriate security measures to protect your data; however, no method of transmission over the internet is 100% secure

Free vs Pro Features

Peek offers different feature sets for free and Pro users. Feature availability may change over time.

  • Feature Changes:We reserve the right to modify, add, or remove features from either tier with reasonable notice; Pro features may become free features, but free features will not become Pro-only without prior notice
  • Current features and their availability are described within the Service interface and may be updated without notice
  • Pro subscriptions provide access to additional features beyond the free tier as described at the time of subscription
  • Feature Updates:Some features may be experimental and subject to change as we continue to improve the Service

Payment Terms and Subscriptions

Pro subscriptions are processed through LemonSqueezy, a third-party payment processor. All payments are subject to the terms and conditions of LemonSqueezy.

  • Subscription Fees:Pro subscription fees are displayed at the time of purchase; fees may change with 30 days notice to existing subscribers; all fees are in the currency displayed at purchase
  • Currency Conversion:We are not responsible for any currency conversion discrepancies that may arise during your payment process; currency conversion is handled by the payment processor
  • Payment Processing:All payments are processed by LemonSqueezy; we do not store your payment information; payment terms are governed by LemonSqueezy's terms of service; you agree to LemonSqueezy's terms when making a purchase
  • Billing Cycle:Subscriptions are billed on a recurring basis (monthly or annually) as selected during purchase; subscriptions automatically renew unless cancelled; you will be charged at the beginning of each billing cycle
  • Refunds:We offer a 7-day satisfaction guarantee for first-time Pro subscribers; after 7 days, no refunds are provided except where required by law; contact us at [email protected] within 7 days if you're unsatisfied; no refunds for partial billing periods
  • Cancellation:You may cancel your Pro subscription at any time through your account settings or by contacting us; cancellation takes effect at the end of the current billing period; no refunds for partial billing periods; you will retain Pro access until the end of the billing period; after cancellation, your account will be downgraded to the free tier
  • Reinstatement:If you wish to reinstate your subscription, you may do so through your account settings at any time; your subscription will resume at the beginning of the next billing cycle
  • Price Changes:We reserve the right to change subscription prices with 30 days notice; existing subscribers will be notified of price changes before they take effect; price changes will apply to renewals after the notice period
  • Failed Payments:If payment fails, we may suspend your Pro subscription until payment is resolved; we will attempt to notify you of failed payments; repeated payment failures may result in subscription termination

User Responsibilities and Acceptable Use

You agree to use the Service only for lawful purposes and in accordance with these Terms. You are responsible for your use of the Service and any content you extract or create.

  • Lawful Use:You must use the Service in compliance with all applicable laws and regulations; you must not use the Service to violate any intellectual property rights; you must not use the Service for illegal activities
  • Prohibited Activities:Reverse engineering, decompiling, or attempting to extract source code; using automated systems to access the Service; attempting to gain unauthorized access to our systems; interfering with or disrupting the Service; using the Service to extract content in violation of website terms of service; using the Service to scrape data beyond personal or authorized use
  • Content Responsibility:You are responsible for how you use extracted content; respect intellectual property rights and website terms of service; we do not claim ownership of content extracted from third-party websites; we are not responsible for copyright or intellectual property violations
  • Respect for Others:You must not use the Service to extract content in a way that violates website terms of service or applicable laws; you are responsible for obtaining necessary permissions; you must not use extracted content to infringe on others' rights; you must not interfere with the functionality of any website
  • Account Misuse:You must not share your account with others; you must not attempt to circumvent subscription limits; you must not use the Service to harm, harass, or violate the rights of others
  • Violation Consequences:Violation of these terms may result in account termination and legal action

Intellectual Property Rights

The Service, including its design, functionality, and content, is owned by Peek and protected by intellectual property laws.

  • Our Rights:Peek retains all rights, title, and interest in the Service, including all software, designs, trademarks, logos, and proprietary information; the Service is protected by copyright, trademark, and other intellectual property laws
  • Website Ownership:Websites inspected using Peek retain ownership of their CSS, typography, images, design assets, and all other content; we do not claim ownership of any content extracted from third-party websites
  • Your Rights:You retain all rights to content you extract using the Service; you are responsible for ensuring you have the right to use extracted content; extracted content may be subject to third-party intellectual property rights
  • Permitted Use:You may use extracted design properties for personal or educational purposes only unless explicitly authorized by the original website owner; commercial use of extracted content requires proper authorization
  • License to Use:We grant you a limited, non-exclusive, non-transferable, revocable license to use the Service in accordance with these Terms; this license is for personal or commercial use as permitted by these Terms
  • Restrictions:You may not copy, modify, distribute, sell, or lease any part of the Service; you may not remove or alter any copyright or proprietary notices; you may not create derivative works based on the Service
  • Feedback:Any feedback, suggestions, or ideas you provide about the Service may be used by us without compensation or obligation to you

Limitation of Liability

To the maximum extent permitted by law, Peek and its operators shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of the Service.

  • Service Availability:The Service is provided "as is" and "as available"; we do not guarantee uninterrupted or error-free operation; we are not responsible for service interruptions due to maintenance, updates, or circumstances beyond our control
  • Data Loss:We are not responsible for any loss of data, including extracted content or saved preferences; Pro users should maintain backups of important data; we recommend exporting important data regularly
  • Website Disruptions:We are not responsible for any disruptions, errors, or issues that may occur on websites you inspect using the Service; the Service is a tool and does not affect the functionality of websites
  • Third-Party Services:We are not responsible for the availability, accuracy, or content of third-party services (LemonSqueezy, Google OAuth, Supabase); your use of third-party services is subject to their respective terms
  • Extracted Content:We are not responsible for the accuracy, legality, or usability of content extracted from websites; you are responsible for verifying and using extracted content appropriately
  • Legal Claims:We are not liable for any legal claims arising from how you use the Service or how you use content extracted from websites
  • Maximum Liability:Our total liability for any claims arising from the Service shall not exceed the amount you paid for Pro subscription in the 12 months preceding the claim; for free users who have not paid any fees, our liability is limited to $0
  • Jurisdiction Limitations:Some jurisdictions do not allow the exclusion of certain warranties or limitation of liability; in such cases, our liability is limited to the maximum extent permitted by law
  • No Warranties:We disclaim all warranties, express or implied, including warranties of merchantability, fitness for a particular purpose, and non-infringement

Termination

Either party may terminate access to the Service at any time, with or without cause.

  • Termination by You:You may stop using the Service at any time; Pro users may cancel their subscription to terminate Pro features; you may delete your account at any time
  • Termination by Us:We may suspend or terminate your access to the Service if you violate these Terms, engage in fraudulent activity, fail to pay subscription fees, or for any other reason with reasonable notice; we may terminate immediately for serious violations
  • Effect of Termination:Upon termination, your right to use the Service immediately ceases; Pro users will lose access to Pro features at the end of the billing period; all licenses granted to you will terminate
  • Data After Termination:Free users' local data remains on their device until manually deleted; Pro users' cloud data will be deleted within 30 days of account termination unless otherwise requested; we may retain certain data as required by law
  • Survival:Provisions that by their nature should survive termination (including intellectual property, limitation of liability, and dispute resolution) will survive termination

Changes to Terms

We reserve the right to modify these Terms at any time. We will notify users of material changes through the Service or via email.

  • Notification:Material changes will be communicated through the Service interface, email (for Pro users), or by updating the "Last Updated" date on this page; we will provide at least 30 days notice for material changes
  • Continued Use:Your continued use of the Service after changes become effective constitutes acceptance of the updated Terms; if you do not agree to changes, you must stop using the Service
  • Disagreement:If you disagree with any changes, you must stop using the Service and may cancel your Pro subscription; cancellation will be effective at the end of the current billing period
  • Version History:Previous versions of these Terms are available upon request at [email protected]; we maintain a version history for transparency

Governing Law and Dispute Resolution

These Terms are governed by the laws of Bangladesh, where Peek is operated.

  • Jurisdiction:Any disputes arising from these Terms or the Service shall be subject to the exclusive jurisdiction of the courts of Bangladesh; you consent to the jurisdiction of Bangladesh courts
  • Dispute Resolution:We encourage users to contact us at [email protected] to resolve any disputes before pursuing legal action; we will make good faith efforts to resolve disputes amicably
  • International Users:If you are using the Service from outside Bangladesh, you agree to comply with local laws while using the Service; these Terms are governed by Bangladesh law regardless of your location
  • Class Action Waiver:To the extent permitted by law, you agree not to participate in class action lawsuits against us

Miscellaneous Provisions

Additional provisions that govern these Terms.

  • Entire Agreement:These Terms, together with our Privacy Policy, constitute the entire agreement between you and Peek regarding the Service
  • Severability:If any provision of these Terms is found to be unenforceable, the remaining provisions will remain in full effect
  • Assignment:You may not assign or transfer these Terms or your account without our written consent; we may assign these Terms without restriction
  • Waiver:Our failure to enforce any provision of these Terms does not constitute a waiver of that provision
  • Force Majeure:We are not liable for any failure to perform due to circumstances beyond our reasonable control
